Terms of Service

These Terms govern the use of the StreamScouter service (the "Service") provided by StreamScouter ("we" or "us"). Registered users ("Users") shall use the Service in accordance with these Terms.

By using the Service, Users are deemed to have agreed to these Terms.

The definitions of terms used in these Terms are as follows:

• "Service" means the viewer analytics service for Twitch streamers provided on StreamScouter (streamscouter.com).
• "User" means an individual or entity that has registered for and uses the Service.
• "Account" means the identification information necessary for Users to use the Service.
• "Content" means all information, data, text, images, and other materials provided through the Service.

Users shall manage their account information at their own responsibility. Users shall not allow third parties to use, lend, transfer, change the name of, sell, or otherwise dispose of their account information under any circumstances.

We shall not be liable for any damages incurred by Users due to inaccuracy, falsity, or use by third parties of account information.

Users shall immediately notify us if their account information is used by third parties or if any other security issues occur.

We may change these Terms. When we change these Terms, we will notify Users by displaying the content of the changed Terms and the effective date on the Service.

Changed Terms shall take effect from the time they are displayed on the Service. If Users do not agree to the changes, Users may terminate their use of the Service.

If Users use the Service after the Terms are changed, Users are deemed to have agreed to the changed Terms.

Users shall not engage in the following acts when using the Service:

• Acts that violate laws or public order and morals
• Acts related to criminal activities
• Acts that infringe copyrights, trademark rights, or other intellectual property rights contained in the Service
• Acts that destroy or interfere with the functions of servers or networks of us, other Users, or third parties
• Acts that commercially use information obtained through the Service
• Acts that may interfere with the operation of our services
• Acts of unauthorized access or attempts thereof
• Acts of collecting or accumulating personal information of other Users
• Acts of using the Service for unlawful purposes
• Acts of impersonating other Users of the Service or third parties
• Acts of advertising, solicitation, or sales on the Service without our permission
• Acts aimed at meeting unknown persons of the opposite sex
• Acts of directly or indirectly providing benefits to anti-social forces in relation to our services
• Other acts that we deem inappropriate

Users shall pay usage fees separately determined by us and displayed on this website as consideration for using the Service, by the method specified by us.

If Users delay payment of usage fees, Users shall pay us late payment damages at an annual rate of 14.6%.

Paid plans are automatically renewed monthly. They will be automatically renewed unless cancellation procedures are performed. For details, please refer to Refund, Cancellation & Termination.

We may suspend or discontinue all or part of the Service without prior notice to Users if we determine that any of the following reasons exist:

• When maintenance, inspection, or updates of computer systems related to the Service are performed
• When provision of the Service becomes difficult due to force majeure such as earthquakes, lightning, fires, power outages, or natural disasters
• When computers or communication lines are stopped due to accidents
• Other cases where we determine that provision of the Service is difficult

We shall not be liable for any disadvantages or damages incurred by Users or third parties due to suspension or discontinuation of the Service.

If Users violate any provision of these Terms, we may restrict all or part of the use of the Service or delete Users' registration without prior notice.

Our liability for breach of contract shall be limited to direct damages actually incurred by Users, and the total amount of usage fees we have directly received from Users in relation to the Service shall be the upper limit for compensation, except in cases of our willful misconduct or gross negligence.

We shall not be liable for any transactions, communications, or disputes that arise between Users and other Users or third parties in relation to the Service.

We do not guarantee that the Service will meet Users' specific purposes, have expected functions, commercial value, accuracy, or usefulness, or that no defects will occur.

We shall not be liable for any damages incurred by Users in relation to the Service. However, this disclaimer shall not apply if the contract between us and Users regarding the Service (including these Terms) constitutes a consumer contract under consumer protection laws.

Japanese law shall be the governing law for the interpretation of these Terms.

If a dispute arises regarding the Service, the court having jurisdiction over the location of our head office shall be the exclusive agreed jurisdiction.
